Please read these Terms and Conditions carefully. Rosa Hope reserves the right to change these Terms and Conditions at any time without notice.
By using rosa-hope.com and/or affilliated links (the "Website"), any QHHT® or hypnosis services provided in connection with the Website ("Services"), or any programs (60-Day Whole-Life Integration Intensive or Spiritual Working Group) provided in connection with the Website ("Programs"), the following Terms of Service are entered into by and between You and Rosa Hope ("we" or "us"). We provide Programs and Services to you subject to the notices, terms, and conditions set forth in this agreement (the "Agreement"). In addition, when you schedule, pay for, use, or otherwise participate in any of our Programs or Services, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such, and they are incorporated into this Agreement by this reference. We reserve the right to change this Website and these terms and conditions at any time. USE OF THE WEBSITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS IN THIS AGREEMENT. If you do not want to agree to these Terms of Service including the agreements incorporated by reference herein, you must not access or use the Website. By using this Website, you represent and warrant that you are of legal age to form a binding contract with us.
A. Intellectual Property Rights. The content, layout, design, data, and graphics on this Website are protected by Unites States intellectual property laws. All content is solely owned by us, except for registered service marks of QHHT® and Quantum Healing Hypnosis Technique℠ which are owned by www.qhhtofficial.com and/or its licensors.
B. Disclaimer. Programs and Services to be provided DO NOT include the practice of medicine or mental health treatment and are not intended to be a substitute for professional advice. Services are non-diagnostic, and are considered tools and education related to personal development.
C. Limitation of Liability. We will not be liable to you or to any other person for any indirect, consequential, punitive, or special damages ("Non-Direct Damages") of any character, whether in an action in contract, tort or otherwise, arising out of or in connection with these Terms of Service. Our liability to you or to any other person for direct damages shall be limited to the fees paid by you for our Programs or Services during the six (6) months preceding the events that give rise to your first claim against us for damages. In the case that your state or jurisdiction does not allow the exclusion or limitation of liability for non-direct damages, the limitations above apply to both direct and non-direct damages.
E. Fees and Billing. Prices are stated on the Website at the time of enrollment/booking/purchase. All fees for Programs are paid upfront at the time of enrollment, with financing options available through Affirm. All deposits for Services are paid upfront at the time of booking, with payment request for the remaining fees sent to the email provided by you upon booking one week before the scheduled date of Services. Full payment is required before Services are rendered, with financing options available through Affirm. Any and all financing agreements are solely between You and Affirm in accordance with their terms and policies.
F. Refunds, Cancellation, and Rescheduling. All Programs, and Services offered within Program enrollment packages, are non-refundable unless cancelled by us. Refunds will be made to the original payment source only. It is Your responsibility to ensure that You can participate during the dates and times of the enrolled Program. If You are unable to participate in a Program after enrollment but before the Program start date, Your paid fee guarantees participation in a later offering of the same Program. In the case that the enrolled Program will not be offered in the future, the Program fee will be refunded.
All other Services are non-refundable at or after the scheduled date and time of Services rendered. All Services may be rescheduled or cancelled by you at any time. Refunds will be made to the original payment source only. Refunds for cancellation of Services are subject to the following:
Services cancelled by us will be refunded in full. For Services cancelled by you fourteen (14) or more days before scheduled date of Services, the deposit and any remaining fees paid will be refunded in full. For Services cancelled by you less than fourteen (14) days before the scheduled date and time of Services, the deposit will NOT be refunded, and any remaining fees paid will be refunded in full. Services cancelled by you at the scheduled date and time of Services are non-refundable, but an option to reschedule is guaranteed.
For rescheduled Services, any deposit or fees paid for the canceled date of Services will be automatically transferred to the new scheduled date of Services. If session fees for scheduled Services are not yet paid in full, an updated payment request will be sent to the email provided by you upon booking with a new due date for payment.
G. Right to Refuse Service. We reserve the right to refuse service to anyone for any reason not protected by law.
H. Notices. You shall send notices to us by email to contact@ rosa-hope.com and addressed to the attention of LEGAL. Notices to you will be sent by email to the email address from which the notice was received. Notices shall be deemed given on the day actually received by recipient, if received as provided in this paragraph before 5 PM on a business day in the recipient's location. Notices received after 5 PM or on a non-business day shall be deemed received on the next business day.
